Traditional knowledge as part of a dynamic and fluid, rooted in tradition, customs, climate conditions and needs of indigenous communities, they form an important part of cultural and social heritage and their identity. Compatible with the climate and the local life, the importance of traditional knowledge of indigenous peoples in economic development and the impact of this knowledge in the sciences and modern innovations, has the originality, durability, mobility and economic value and as a result some of the abuse , illegal appropriation and exploitation of its owners brought it without rights. Hence the legal protection from the owners of indigenous communities of this knowledge are essential, based on the requirements of human rights and as the best framework for protecting intellectual property system is proposed. Measures and studies World Intellectual Property Organization to promote the protection of indigenous peoples' knowledge is valuable and significant, passing appropriate international rules which is the first and most effective step for widespread support of the owners of this knowledge requires the cooperation of all countries, especially countries with indigenous communities and it is necessary to Iran shows more activity, in this context and in line with the pass of appropriate national legislation. دانش سنتی ساختاری است پویا برای تولید و سازماندهی یافته‌هایی از طبیعت بدون دخالت ماشین که ریشه در نسل‌های گذشته دارد. دانش سنتی به عنوان جزئی پویا و سیال، ریشه در سنت، آداب و رسوم، شرایط اقلیمی و نیازهای جوامع بومی داشته، بخش مهمی از میراث فرهنگی و اجتماعی آنها را تشکیل داده و معرف هویت آنها می‌باشد. سازگاری با شرایط اقلیمی و زندگی بومی، اهمیت دانش سنتی در رشد و توسعه اقتصادی مردمان بومی و اثرگذاری این دانش در علوم و اختراعات امروزی، به آن اصالت، دوام، پویایی و ارزش اقتصادی بخشیده و در نتیجه عده‌ای را به سوی سوء استفاده، تصاحب نامشروع و بهره‌برداری از آن بدون رعایت حقوق صاحبان آن کشانده است. از این روی حمایت حقوقی از جوامع بومی صاحبان این دانش ضروری بوده، مبتنی بر اقتضائات حقوق بشری است و نظام مالکیت فکری به عنوان بهترین چارچوب حمایتی پیشنهاد می‌شود. اقدامات و مطالعات سازمان جهانی مالکیت فکری به منظور گسترش حمایت از دانش مردمان بومی ارزشمند و قابل توجه بوده، وضع مقررات مناسب بین‌المللی که اولین و مؤثرترین گام برای حمایت گسترده از صاحبان این دانش است، نیازمند همکاری تمام کشورها خصوصاً کشورهای برخوردار از جوامع بومی است و لازم است ایران در این زمینه و همچنین در راستای وضع قانون ملی مناسب فعالیت بیشتری از خود نشان دهد. https://jpl.sdil.ac.ir/article_42030_2fe8c763d38d70e7d3e00b95f22a48be.pdf
